The Trump Administration Seeks High Court Clearance for Military Reserve Troop Deployment in Illinois

On the last weekday, the administration filed an emergency request to the nation's highest court, requesting clearance to send state guard personnel to Chicago and surrounding areas.

This move is part of a wider effort to increase the internal deployment of the troops in a number of cities run by Democrats.

Court Fight Over Troop Deployment

In an immediate request, the US Department of Justice asked the court to overturn a previous judicial decision that had stopped the stationing of hundreds of military reserve members to the Chicago area.

The federal judge had expressed skepticism about the government's reasoning for deploying forces, challenging its reasoning in given the situation on the ground.

Regional authorities claim that rallies over ICE activities have been primarily limited and peaceful, contrasting with the administration's description of “battlefield” situations.

Statutory Grounds

At the center of the conflict is the government's invocation of a US code permitting the president to take control of the military reserve only in situations of uprising or when “unable with the standard military to carry out the statutes of the United States”.

The government insists that the troops are essential to protect US facilities and officers from demonstrators.

Recent Events

Previously, the White House federalized 300 members of the Illinois military reserve and ordered additional guard from Texas forces into the state.

As local leaders criticized the action, the president intensified his language, calling on the detention of Chicago’s mayor and the governor of Illinois, the two Democratic officials, alleging them of not managing to secure federal agents.

Illinois and the city of Chicago jointly sued the government to halt the activation.
